This Privacy Policy is designed to assist you in understanding how Elate will collect, use and safeguard any personal information you provide on the website app.goelate.com and through our Elate Service. By using our Services, you agree to the terms of the Privacy Policy and to any applicable terms of service. The use of the Elate Service is governed by our Terms and Conditions, which contains disclaimers, limitations of liability and includes a choice of Indiana law and jurisdiction.

Security

Elate has implemented processes intended to protect user information and maintain security of data that we process. Each account holder is assigned a unique username and password, which is required to access their account. It is your responsibility to protect the security of this login information. When you enter sensitive information (such as your login information) on our site, we encrypt the transmission of that information using secure socket layer technology (SSL). We have attempted to protect Elate’s servers by locating them in areas with security procedures, use of firewalls and implementing other generally available security technologies. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of data, but no guarantee can be made that your information and data will be secure from intrusions and unauthorized release to third parties.

Application Data

As part of the Elate Service, we store goals, objectives, and metrics, as well as any data that was collected from those goals, objectives, or metrics in our operations platform. We respect the privacy of all users, and consider all data that is collected to be private. Elate may access this data only for the purpose of providing the Elate Service, preventing or addressing service or technical problems, at a Customer’s request in connection with customer support matters, or as may be required by law. Elate will not distribute or sell your information to a third party, except as disclosed in this policy. When you utilize the Elate Service from outside of the United States, data is submitted and transferred into the United States and you hereby consent to such transfer.

Elate collects information under the direction of our clients (“Clients”), and has no direct relationship with the individuals whose personal information it processes. We collect information for our Clients, if you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our Service, please contact the Client that you interact with directly.

Account Information

We collect email addresses from those who contact us via email, and ask for information such as email address and name when you sign up for an account with Elate. The information we collect is not distributed or sold to a third party, except for use in the platform as detailed in the Sharing Information section. It will only be used to communicate with you about your Elate account, and where needed as part of certain Elate features. You may update, change or delete your account information at any time by accessing your information on your account or contact us at support@goelate.com or by contacting us by telephone or postal mail at the contact information listed below. We will respond to your request to access personal information within 30 days.

We will retain information we process on behalf of our Clients for as long as your account is active or as needed to provide Services to our Client. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

If you wish to subscribe to our newsletter, we will use your name and email address to send the newsletter to you. Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us at support@goelate.com.

Web Server Logs

For statistical purposes, Elate will gather certain information automatically and store it in log files. These log files contain standard information collected by web servers, such as Client IP addresses, browser type, internet service provider (ISP), operating system, etc. This information is only used internally, and is not distributed or sold to a third party. Elate uses this information, which does not identify individual users, to analyze trends, to administer the Elate website and to gather demographic information about its user base as a whole. Elate does not link this automatically collected data to personal information.

Sharing Information

We will share your personal information with third parties only in the ways that are described in this Privacy Policy. We do not sell your personal information to third parties. However, any information collected by Elate may be shared if it is necessary to investigate, prevent or prosecute illegal activities, suspected fraud, violations to the Terms and Conditions, or as otherwise required by law or a valid government request (including, but not limited to, search warrants, subpoenas or court orders) and when we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others. Elate may also share information if it is acquired by or merged with another company. In this event, Elate will notify you via email and or a prominent notice on our website before information is transferred and becomes subject to a different privacy policy.

We may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

We also may provide your personal information to companies that provide services to help us with our business activities such as, but not limited to, our hosting or analytics provider. These companies are authorized to use your personal information only as necessary to provide these services to us.

Consent

We provide you the opportunity to “opt-out” of having your personal information used or disclosed for certain purposes. Specifically, we offer you the opportunity to opt-out of: (1) the disclosure of your personal information to a third party that is not acting as an agent of Elate, and (2) the use of your personal information for a purpose other than the purpose for which it was originally collected or subsequently authorized by you. When we collect sensitive personal information (such as personal information about your medical or health conditions, racial or ethnic origin, political, religious, or philosophical opinions and beliefs, trade union membership, or sex life) from you, we will first obtain your affirmative, express (“opt-in”) consent prior to disclosing the sensitive personal information to a third party or using it for a purpose other than the purpose for which it was originally collected or subsequently authorized by you.

Personal Information

Personal Information refers to any information that you voluntarily submit to us and that identifies you personally, including contact information, such as your name, e-mail address, address, phone number, and other information about yourself.

At the time of collection, we will clearly identify the information being collected and the purposes for which it will be used. For example, to create an account you provide data including your name, email address and/or mobile number, and a password. It is always your choice whether or not to provide Personal Information. Your choice not to provide certain other Personal Information may mean that you will not be able to use certain features of the Services.

Rights To Your Data

You, as the data provider within Elate, have the following rights to your personal data:

  1. Your right of access: You are allowed to access any personal data Elate stores from you.
  2. Your right of rectification: You have the right to amend or change your data
  3. Your right to erasure: You have the right to request that Elate remove all of your personal data from the systems that hold it. You can do this by sending a request to support@goelate.com
  4. Your right to restriction of processing: You can control what level of data processing Elate can perform on your personal data. Note that in some cases it may affect our ability to perform certain services within the application.
  5. Your right to object to processing: You are entitled to object to any data processing before it occurs.
  6. Your right to data portability: You have the right to request any data that Elate has relating to you in any reasonable, modern format.
  7. Your right to withdraw consent: You have the right to withdraw consent at any time. Withdrawal will not affect processing that occurred before receiving notice of your wish to withdraw consent.
  8. Your right to lodge a complaint with the data protection authority: If you remain dissatisfied, you can make a complaint about the way we process your personal information to the supervisory authority.

Purpose of Data Collection

Elate collects information on its users to provide several key support services. This includes such services as: personalized notifications, live support chat, and usage analytics. Many of these features are configurable based on an individual’s preferences, but in some cases may prevent certain features from working properly.

Elate may use Personal data with your consent or as is necessary for the following business interests:

  • To provide support services in our application
  • To gather product usage information to develop new features
  • To send administrative messages, such as updates to the privacy policy
  • To send application messages, such as password reset emails
  • To support and protect Elate, prevent fraudulent activity or misuse and ensure the integrity of our internal systems.

This includes adhering to the principles of legality, fairness, and transparency; limiting data collection to specific purposes; minimizing the amount of data collected; ensuring accuracy; limiting data storage; maintaining integrity and confidentiality; and being accountable for data Protection.

Cookies

Technologies such as cookies, beacons, tags, and scripts are used by Elate and our marketing partners, affiliates, or analytics or customer service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site, and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

Third-Party Integrations

Elate may use data collected from third party integrations to provide dashboards for its users. For example, if you connect a Google integration to the Platform, we may regularly pull data from services such as Google Sheets, Google Analytics, or Google Drive to use in the system. Elate may also use this data, in aggregate, to provide benchmarks that clients can use when evaluating their organizational metrics.

Elate will not sell or distribute the data collected to any outside services and Elate does not write or modify data stored in the third party services.

Third-Party Websites

Elate is not responsible for the practices employed by websites linked to or from the Elate website, nor the information or content contained therein. When you use a link from the Elate website to another website, our Privacy Policy is no longer in effect. Browsing and interaction on any other website, including websites which have a link to the Elate website, is subject to that website’s own rules and policies.

Elate Use of Testimonial, Logo or Brand

We display personal testimonials of satisfied customers on our site in addition to other endorsements. The use of logo or brand is agreed upon in the Subscription Agreement. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, please contact your customer support representative.

Changes

Elate reserves the right to update this policy at any time without prior notice. You will be notified of changes or updates when you access your account. Your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that you are consenting to the updated Privacy Policy. Any new features or tools which are added to the current Service shall also be subject to the Privacy Policy.
